General Terms and Conditions

TERMS AND CONDITIONS – DesertPearL

In these Terms and Conditions, the following definitions apply:

DesertPearL: the company operating under the trade name DesertPearL, established at [address to be completed].
Customer: any natural person or legal entity placing an order with DesertPearL.
Product(s): all natural skincare products, oils, and accessories offered by DesertPearL.
Agreement: any purchase agreement concluded between the Customer and DesertPearL through the webshop.
Right of Withdrawal: the Customer's right to cancel the Agreement within 14 days after receiving the order.

These Terms and Conditions apply to all offers, orders, and agreements made through www.mydesertpearl.com.
By placing an order, the Customer agrees to these Terms and Conditions.

DesertPearL takes the utmost care in the composition, presentation, and description of its products.
Images, colors, and packaging may differ slightly from the actual product.
Obvious errors or mistakes are not binding on DesertPearL.
Due to the natural characteristics of our products, fragrance, color, and texture may vary between production batches. Such variations do not constitute a defect.

All prices are stated in euros (€) and include VAT, unless otherwise specified.
Shipping costs are displayed separately during the checkout process.
DesertPearL reserves the right to change its prices. Orders already placed will be charged at the price applicable at the time of purchase.

Payment must be made using one of the payment methods offered in the webshop.
Orders will only be shipped after full payment has been received.
DesertPearL reserves the right to cancel an order if fraud or misuse is suspected.

DesertPearL aims to dispatch orders within 1–2 business days.
Delivery will be made to the address provided by the Customer.
DesertPearL is not liable for delays caused by shipping carriers.
If a product is unavailable, the Customer will be informed as soon as possible and any amount paid will be refunded.

Ownership of the products transfers to the Customer only after full payment has been received.
The risk of loss or damage passes to the Customer once the order has been delivered by the shipping carrier.

The Customer has the right to cancel the Agreement within 14 days after receiving the order without providing any reason.
Returned products must be in their original condition and original packaging.
The Customer is responsible for the return shipping costs.
DesertPearL will refund the purchase amount within 14 days after receiving and inspecting the returned product(s).
If a product has been opened, used, or damaged, DesertPearL may reduce the refund to reflect the diminished value or refuse the return.

DesertPearL guarantees that its products comply with all applicable European Union cosmetic regulations.
Natural variations in color, fragrance, or texture do not constitute a product defect.
DesertPearL cannot be held liable for allergic reactions or improper use of its products.
Customers are advised to perform a patch test before using a product if they have sensitive skin or are unsure about possible reactions.

Complaints may be submitted by email to contact@mydesertpearl.com.
DesertPearL aims to respond to complaints within 3 business days.
If a complaint cannot be resolved amicably, the Customer may submit the dispute to the competent dispute resolution body or the competent court.

DesertPearL shall not be liable for indirect damages, consequential damages, or loss of profits.
Any liability of DesertPearL shall always be limited to the total amount paid for the relevant order.
DesertPearL shall not be liable for errors or delays caused by shipping carriers or other third parties involved in fulfilling the order.

DesertPearL shall not be obliged to fulfill its obligations in the event of force majeure, including but not limited to natural disasters, technical failures, pandemics, strikes, transportation disruptions, or other circumstances beyond its reasonable control.
If a force majeure event occurs, the Customer will be informed as soon as reasonably possible.

DesertPearL processes personal data in accordance with the General Data Protection Regulation (GDPR).
Personal data is processed solely for the following purposes:
- Processing and shipping orders;
- Communicating with Customers;
- Administrative and accounting purposes;
- Marketing communications for which the Customer has provided prior consent.
Personal data will only be shared with third parties where necessary for the execution of the order (such as payment providers and shipping partners) or where required by law.
Customers may request access to, correction of, or deletion of their personal data by contacting contact@mydesertpearl.com.
DesertPearL does not retain personal data longer than necessary.
Customers may voluntarily subscribe to the DesertPearL newsletter.
The newsletter is sent only to Customers who have explicitly provided their consent (opt-in).
Customers may unsubscribe at any time via the unsubscribe link included in every newsletter or by contacting us via email.
A Customer's email address will be removed from the mailing list without unnecessary delay after unsubscribing.
DesertPearL uses an external email service provider to send newsletters. A Data Processing Agreement has been concluded with this provider to ensure the protection of personal data.

These Terms and Conditions, and all agreements and transactions concluded with DesertPearL, shall be governed exclusively by the laws of the Netherlands.
Any disputes shall be submitted to the competent court in the judicial district where DesertPearL is established.
